Whoops - Developers forgot to build 2 levels of Carparks

    I know but my gripe is that larger developers get away with these stunts all the time and yet do something similar to an extreme scale scale and watch them come down.

    Appears as though OTP contracts aren't worth the paper they're written on. The legislation needs to change. It's ridiculous.

    I've come to inspect my house
    There it is
    But, that's a house for ants

    Well the person agreed to the T&C of the contract, their fault.

    Do you think it's more of a reflection of where the cities are in the cycle rather than the cities themselves?

    Ie if Perth was going nuts and OTP units being worth a bucketload more at completion than when contracts were signed years earlier similar would be happening?

    Not a lawyer, but you would think common law around misrepresentation / false advertising would provide some level of argument - particularly if properties are advertised with a certain number of parking spaces and storage as a main selling point.

    There was a lawyer on 3AW that mentioned that the TPA comes into play here and there has to be precedent....

    There was also a story on A Current Affair around the Developer ripping people off under sunset clause in Sydney - worth watching.

    Only two markets that have gone up a fair bit in last 3 yrs that's why ur seeing it more in these two cities

    Even during perths massive boom this did not occur, or if it did it was a rarity.

    If council approved the plans to have a lower carpark ratio. if council approves carpark ratio to say 1:0.7 , then the developer can build less carpark. The contract of sale is usually quite biased to the developer to make changes to the development without consent of the purchaser. Just make sure carparks are on title, then you have some grounds of argument. check out this website to see if the developer is credible. http://www.crediblepropertydevelopers.com/
