If a solicitor holds your title deeds and you wish to use a different solicitor, how do you move the title deeds to another solicitor? Also what is the cost etc
Is the title deed now just a souvenier ? Many deeds have been converted to electronic title and are useless for transactional purposes. Generaly those which were held by a lender at the relevant 2018 date (or later). eg NSW but all tile dees are about to be impacted : Conversion of paper Certificates of Title to electronic Certificates of Title - NSW Land Registry Services NSW laws were passedin the last few weeks to change all title deeds in NSW to electronic from 1 October but conversion will occur prior Real Property Amendment (Certificates of Title) Bill 2021 approved by Parliament -
I know the thread is around NSW but just want to ask if prop purchase is in WA and no banks involved then do we hold the deed, if Yes, how will it work if we want to take money (loan) in 6 month or one year to do the extension of this IP? apologies, never bought a house outright or done any reno
The financier will request the deed, register the mortgage & hold on to it when it comes back from registration.
I recently went thru this in NSW. Had requested my "file" including one title several times from a solicitor, appointments made to pick up but no one there...... Ended up requesting in an email it be registered posted to me, nothing ! Due to the sale I had the property solicitor reach out, "sure no problem, come pick it up" Ended up I had my property solicitor convert it to a digital title instead (as per @Paul@PAS the paper title is now an ornament) and the sale went thru. The old solicitor still holds my file, now with nothing important in it
