Terminating tenancies on grounds of illegal drugs stored in IP

    My parents had a house in North Melbourne many many years ago. They had tenants recommended by a very well known politician at the time. As it turned out, the tenants were into drug dealing in a big way, and not just weed. The place was subject to a number of police raids, which continued for the next set of tenants.

    They ended up selling as a result - a pity, as that was in the day when North Melbourne wasn't particularly trendy or expensive.

    I don't know if it makes a difference - but are we talking about Queensland? There will be different laws between states.

    Agreed, but I don't think too many tenancy agreements are terminated on those grounds alone.

    Yes, Qld, thanks. The information and suggestions so far have been very good. It is interesting how the different states approach this.

    For nuisance essentially? Not too many private tenancies but a fair few public housing ones.

    Most of my trial work as a junior lawyer was for these sorts of matters.

    I bet you have heard some really interesting matters! The RTRAA seems to be a bit tougher with a lesser burden of proof for public tenants/state lessor, especially with 'proving' illegal activities. I was just about to start looking through Austlii for any QCAT/Supreme Court cases - or are these cases all subject to non publication orders?

    Just had a look through using RTA and breach as search terms. I am surprised, I would have thought there would be a lot more cases. Hopefully mediation and communication has solved a lot of cases before it gets that far.
