I got puzzled how this subdivision got done 24 & 26 Handley Avenue, Thornleigh NSW 2120 - Development Site For Sale | Domain as area is bush fire zone, plus Lot 3 is approved for Duplex! where Hornsby council explicitly states that no duplexes allowed in R2 zone. Is this an example of corruption, or there is a loophole that allows duplex developments against rules?
How close is it to a R1 zone ? I have seen council allow rules for a nearby zone to be applied. We just had L&E overturn hills shire objections on this...The high rise (R4) zone was 1km away !! They said you could see if from the new proposed tower so its close enough. Council argued you wouldnt see anything if it complied with R1. L&E considered that for 10seconds before approving 10 out of 11 grounds to object which defied LEP. Developer withdrew one breach and it was then given green light.
