Sold house new owner complaining about garden

    Partner just sold a house.

    In the contract it was subject to a building inspection and "clearing leaves and loose items from yard"

    I had cleared the leaves and what not couple weeks ago.

    Anyway settled yesterday and new owners complaining yard is not clean. Conveyances are saying they (new owners) are going to get someone to clear it and send us an invoice.

    Can they do this? And do we have to pay for said invoice?

    I feel like they are just being *******s. My partner even agreed to let them move in one day early and let them into the house a few weeks before settlement so they could bring trades people there to get quotes on new work they were going to be doing. I have asked for this type of deal many times when I have bought IPs and have been told no every time. So thought it would be a friendly gesture to let them do it.

    And in return get complaints about a leaves.

    Oh and the agent we used to sell house is conveniently "away"

    You're in SA and they don't do pre settlement inspections do they?
    In any other state this would all be sorted out then.
    Anyway on settlement day it's supposed to be the same condition (or agreed condition). If it was a couple of weeks ago then it could be full of leaves again.
    But I would expect AFTER settlement is not the time to wrangle.

    Yea there could be a few leaves after a couple weeks but geeze its leaves

    You must be talking about less than $100 - I wouldn't stress too much.

    Doubt the invoice would arrive.

    That is assuming it is just leaves - did you inspect it yourself ? Maybe some other stuff is there.

    The fact they moved in the day before settlement suggests they would have known about the issue and could have brought the issue to light before settlement.

    Instead, they did not, let settlement pass, and have now changed their mind. Far better circumstance than just an inspection.

    Get your conveyancer to politely decline any post settlement issue due to the above fact.

    What pinkboy said... plus remind them you let them move in early, prior to settlement and allowed them entry weeks ago to let trades in to quote. You could have said "no" to both requests.

    It never ceases to amaze me how petty some people can be. Who are they going to get to rake up the leaves that fall next week? Sheesh!

    Give the invoice to your kids for drawing paper...and the next one....and the next one, etc.

    If an invoice arrives, I'd be sending back another for 1 day's rent to offset it. :p

    normally if a seller Grants early access the buyer signs something confirming they're happy to take the property as is etc; was there anything like this done?

    alternatively, for a bit of a laugh, go around and round up 2 of the roughest homeless looking meth heads and offer them a bit of cash to get rid of the leaves, the more off their heads they look.the better.

    then sit back and enjoy a bit of a chuckle when the buyer freaks out.

    Whilst you can wait for them "try one on" and ignore it, post it back or eat it, I'd get in first and make sure their solicitor (or yours) cuts them off at the pass, before they spend anything on trying to squeeze anything from you. Things can escalate quickly.
