Selling without a final Occupational Certificate

    Hi All,

    I have recently moved into my PPOR which is a new build and have only obtained a Interim Occupational Certificate, if i ever wanted to sell it is there any legislation saying i need to obtain Final occupational certificate before selling?

    Do I ever need the Final OC?

    Your purchaser's solicitor will probably make it a condition in the contract they sign, that you as vendor must supply the final OC.

    But its not necessarily a requirement to change names on the title?

    It would be apart of the solicitors checks before signing the contract and they would then note it in the contract to be supplied by the vendor? Just trying to understand the process.

    No, BUT unless you have a cash buyer, you may find an incoming mortgagee may make it a mandatory requirement before providing funds and therefore transfer of title.

    Make sure your sale contract properly contemplates this situation so you don't get caught out. Plenty of properties are sold with an interim OC but usually only new properties (ie not year after the interim OC was issued).
