Routine inspection notice period -QLD

    Hi folks

    I've been given an entry notice overnight for an inspection of my apartment. The email I received said that it's for a routine inspection, however the type of inspection on the Form 9 isn't ticked.

    What's baffling me is that the date of entry is this Friday, the 27th of Oct, whereas this type of inspection is supposed to have a 7 day notice period in QLD.

    I'm afraid that if I consent to the manager giving such short notice for an inspection, that this will create a precedent and my rights as a tenant and the law won't be honoured in future by the manager. They have just taken over management of the building.

    I've contacted them and am yet to hear back. I've also contacted the RTA for clarity.

    As I know there's some experienced landlords and PMs here, I'd like to know what you guys think of this situation.

    It's 7-14 days here in SA, I assume its similar there.

    It could be just an error - I was booking some inspections once and accidentally put one as today's date rather than the inspection date. Obviously went back and corrected that quickly.

    Talking to people is the best way, you find out more then.

    Is it for a routine or for one of the other items on the Form 9? Quite a few of them do allow 24hrs.

    Or if they said it wasn't a mistake, what happened after that? Did you ask for 7 days?

    Sounds like this is your first rental? Welldone for wanting to do it right.

    Here in Qld rules are very transparent. You can find most info from the RTA website and it's good to read thru them all. In fact we give our Tenants a Booklet for Tenants from RTA. Good bedtime reading and we like to educate our Tenants.

    Entry Notice for each type of entry is very specific, from 24-hrs to 7 days. It's not hard so I find it rather interesting that your PM didnt do the right thing.
    Examples:
    • Inspection for valuation: 24 hrs
    • Inspection I other than for a short tenancy moveable dwelling (Routine Inspection) - 7 days
    On another note, do look at routine inspection as something positive for both parties: As Owners they want to know that the property is being well-looked after and identify issues at an early stage. For Tenants, it is a good opportunity to point out any issues and ensure it ties with Entry Report when first move in, and if it is major you'd get protection when exiting.

    It's for a routine one. I was an idiot and told them I would accept this time only.

    Is it standard practice for PMs to do this a test?

    No, but certain PMs (as you have found out) try it on with unsuspecting tenants because you are able to agree to it.

    Next time tell them you're not allowing access and require 7 days' notice.

    I Agree with Andrew its not common practice and I would refuse entry. I will send out ENs for Routine Inspections 3-4 weeks before inspecting the property so I know what I have planned for the month and the tenant has been given adequate time for the inspection.

    I'd allow entry this time seeing you've already agreed to it, rather than them think you are a smartie exercising your rights and make them wonder if you will be "trouble" going forward.

    But I'd let them know, politely, that in future you'd like the proper notice. That lets them know that you understand your rights without making too big a fuss this time.

    I know there is rights but at the same time if you agree to something different then it was agreed. As @wylie points out let them through but if the time wasn't convenient then you can reject their inspection for not correct period.

    For me if someone wanted to inspect my home I would have no issues (although I own the home so I would just reject it) as it is always in a clean state so who cares if it is today or next week having it next week means I would have a week to think about oh maybe I should do this etc etc.

    Couldn't have said it better myself.

    I think you've done the right thing. If you're comfortable letting them through, them why not- but as you've done, just make sure they know that it's not cool to give you less than two days notice.
