Rental bond Expiry

    For rental bonds, is there a set period of when it must be returned to the tenants? My tenants just left and they have been stalling me for rent and damages owed. The bond doesn't cover it but I just want to make sure that it doesn't get automatically released.

    It doesn't ever automatically release.

    If they're stalling you I doubt they're going to do anything. Just claim it and be done with it.

    I'd claim it and let them fight for it, rather than allow them to claim it and you have to fight for it.

    When you lodge your clam, the bond bored will right to the tennant at there last known adress. If they dont get a response, the bond will be released to ewe.

    It doesn't get automatically released. If you or the tenants lodge a bond refund form, then there is a set period of time the other party must claim by and if it doesn't than that is where it gets released. By the sounds of it, I would definitely start the process and claim it, which will show to the tenants your serious on getting it sorted as soon as possible.

    Is there a way I can check this? I haven't been notified but I want to make sure that the communication didn't just go missing.

    Pick up the phone, call OFT, quote the Bond number and find out the status.

    You can also check your nominated bank account.

    Why wouldn't you just claim the whole bond? If they get in before you, you lose the upper hand. If they've not advised a forwarding address, the paperwork will go to the IP and they'll not even get the chance to dispute it.

    In Vic you have 10 business days from the date the tenant vacated to refund the bond or lodge a claim against the bond at VCAT
