Occupation certificate and registration of strata

    As your Consolidation plan and Strata plan have been registered indicates council have signed the subdivision certificate and all of the Surveyors DA conditions have been met.

    The conditions for a DA are site specific and may differ between councils.
    Some typical conditions required prior to issue of final OC could be either or ;
    • Final Certification Tree Preservation
    • Damage to Council Assets (replacement of crossover and pathway)
    • Works as Executed Plan (Registered Surveyor)
    • Creation of Easements (Registered Surveyor)
    • Boundary Fencing
    • Garbage Collection Easement (Registered Surveyor)
    • Waste Management Details
    • Provision for National Broadband Network (NBN)
    • Completion of Landscaping
    • Retaining Walls
    • External Lighting
    • Unit Numbering
    • Consolidation of Allotments (Registered Surveyor)
    • Waste Management
    • Noise –Plant and Machinery
    • Fire Safety Statement
    • Mandatory inspections of nominated stages of the construction inspected.
    • An occupation certificate must be issued before occupying any building or commencing the use of the land.

    Are those underlined items supposed to be completed already for my case as the plan has been registered?

    Yes the survey components would have been required before council would sign their panel on the survey plans and ultimately enabling registration of the Strata plan.

    However, there could be other items outstanding that the developer must now submit to obtain a final OC.
    The other items I have listed are just examples of typical DA conditions.
    Maybe check on Councils' DA Tracker or If the Agent doesn't know, the next best option would be the approaching Council. They may give you the information you seek.

    Hello all,

    My question is related to the Occupancy Certificate. I am purchasing a townhouse Off-The-Plan though it is almost complete but still has some things pending (some painting, flyscreens, blinds, electrical fittings, cleaning etc).

    However, even at this stage the Real Estate Agent has advised that the OC will be issued this week. I have my doubts as he said the same thing last week but said there was a 'slight delay'. At this point going by the definition of OC, I would imagine everything needs to be 100% complete before it is issued. So my question is, can OC be issued in spite of the pending items above?

    I don't see why those would stop the issue of the OC.
