Notice to vacate + Notice to renovate

    Hi all,

    I have a tenant whose fixed lease ends on 31-March-2021, and my PM had already served 120-days notice to vacate. Tenant replied saying that they would not leave , and they would appeal to VCAT against our possession of the property.

    I understand that we no longer can evict a tenant based on end of tenancy.

    If we provide the additional Notice to Renovate to VCAT, would we be able to get the termination and possession orders ?

    I want to fix the widening cracks on the walls and ceiling, and change the clogged sewage system. Is this sufficient or should renovation plans include more items ?

    I'd appreciate your advise on this. Thank you.

    I am working overseas. According to my agent, after the covid protections are removed at end March, there would be a new legislation saying that we can't gain possession of the property simply based on end of tenancy. The ball is in the tenant's court.
