Land boundaries and services separation after sub-division

    Hi All,

    I have signed a contract for a block of land that has been sub-divided (apparently ages ago) 27 Pershing St, Keperra. I have two question and need help to understand what's going on.

    They have demolished a house recently on the parent block which is street number 27. So the parent block has had all the services. Now there are two lots with 27 and 29 street numbers. When I contact urban utilities they can confirm that 27 has services but they don't know about 29. My question is, is there anything should have done after sub-division or before they sell two lots?

    The other question is, there are no land boundaries for those two lots. I don't know the boundaries of my lot. There is a water meter right at the middle of two blocks and no idea which side it is in. They may have done the boundary identification survey. How can I know if they have done the survey without relying on what agent says?

    • Order a drainage diagram
    • Commission your own boundary definition survey
    • Services identification survey
    What due diligence did you perform when purchasing?

    and are there two seperate property tiltes attached to your contract.
    what are you buying exactly ?
    have you a copy of a survey in the contract ?

    1st stop... legal advice
    2nd..........maybe a surveyor

    The two properties should be completely independent before they hit the market... as above -

    If the land has been subdivided then it has boundaries - but it may have no fencing.
    It may or may not have utilities connected.

    No need for subdivision to happen before the properties hit the market - off the plan sales are possible. But new titles will need to be issued before settlement.

    Have you signed contracts for this yet?

    @Terry_w - OP has signed contracts.

    @Samj - IIRC, I had bought a couple of sites several years ago which had been subdivided in Sydney - I still had to bring services to the site (mains located just outside of boundary). Though subdivision was 30-40 years prior.

    Whether services are brought onto or adjacent to the site will be dependent on the original conditions of the DA for subdivision.

    Your rates notice will indicate a sewer/water availability charge which means that you'll be able to connect to the services shown.
