house unconditional and dishwasher has died...

    If you have it listed as an inclusion, then yeah, it needs to be there, but it "legally" does not need to be working unless that is in there, but of course they will expect it to be.

    I just sold one where dishwasher was excluded, buyer asked and wanted it after unconditional, so we accepted less than 150 for it in working order, so I would get person handling matter or agent to ask them if they will take say 100 as an allowance so they can put it toward one they want, or to repair.

    You would not even get a look in in any mildly warm market in NSW asking for that.

    So is that a WA standard contract line, or something you put in there ?

    I have thought about doing it, but I prefer to negotiate a price that would cover replacing it all and then some anyway, no doubt day after inspection and following 6 months many things will stop or break esp. once tenanted & frankly, even when not rushed, never had the time to make sure everything works properly anyway, say a dishwasher, quick cycle is about 60 mins on our last one.....

    I suppose it depends as I said above, what a persons expectations are, I know things will break or be worn to within an inch of life, so I do not focus on it, but in saying that, I know what I am looking at with most items.

    I suppose you could hammer the vendor on price and then go and pick holes in all the small things too, I think all settlements would fail if I did this :) That wording is too broad for me as well if I was vendor.

    On 2 occasions my hot water system has gone kaput a week or so before settlement. It's like they know. You could just walk away or you could do what we did and replace it. Either way is legal in Queensland. But if you choose the other they will never forward your mail.

    It's quite buyer friendly here. That line is added by most Seller REAs in the contract but the standard conditions state that all fixtures must be in good working order (so if broke take them out at sale time) and they/the house/the garden must be in the same condition as at offer time.

    24-48hrs before settlement everyone does a presettlement inspection and tests everything and if it's broken then it's to be fixed or compensated. Believe it or not I had a doorbell fixed due to this :p

    It's very normal to have:
    1. subject to finance
    2. subject to B&P

    No cooling off periods but all very nice and civilised :p

    I expect the damage would have occurred prior to the contract being signed?

    Got advice from my conveyancer on it. Can't be held responsible for anything once contract is unconditional, or even more so once they had moved in. This is why everyone advises you to get your insurance policy setup in case house burns down during settlement, as buyer is responsible for everything here - caveat emptor.

    Next dilemma. ....

    I'm talking some ikea shelves off the wall and there was an incident with the kids trying to climb the book shelf and ripped off the wall. I moved it across and rehung it to hide the damage.
    Wife wants me to patch it but i say good luck to the next owners. Leave or fix? (Keep in mind my patching gear is packed away)

    I'd patch it. Bunnings trip and $10 will see you with the requirements (if you don't want to try to find them in your packed gear).

    I doubt you "have" to patch it, but I would.

    The burning guilt got to me! Grabbed some gear to patch..... though Once i pop i can't stop! So I'll quickly fix a few others once i get started

    i need to boost the score up a little as i know every little thing that has problems, or needs work soon. but a building inspection would have picked these itmes up, they only did a pest report from my understanding
