    Im sorry but in all the time you have spent bumbling around making a mess of things and digging yourself deeper into a hole, you could have just engaged a PM and even if you paid a fee for service for their time to evict them, would be ahead financially and stress/emotionally.

    Stop being tight and pay someone to sort this out for you.

    It maybe her first investment a lot of new investors go in with bright eyes thinking they will be able to handle the management. It's not until they get into a messy situation then realise it is not as easy as it looks maintaining the tenancy.

    Not entirely sure some people are fit to be landlords, especially without PM supervision.

    @MS LOLLYLEGS my advice is to follow what the vast majority of people (the ones you posted asking advice from) on here have told you to do and hire a good PM to handle this process for you. It seems to me that you are not taking the advice of some very seasoned investors/professionals.

    @Mick Butterfield seems more like the case of people only hear what they want to hear.
    In this case, its tips on how to get rid of a tenant yourself when you don't have a clue...

    Its a shame that none of these seasoned investors seem to know how to handle this on their own and choose to defer it to the professionals so they can spend their time making money elsewhere... i mean what chickens! ;):rolleyes:

    And having directed advised and represented clients on such matters, I would say its arguable whether they would be considered grounds - and even if they were considered grounds under that provision, they would fall well short of the 'bar' to justify termination.

    Best to stick to the easier-to-prove grounds for termination.

    Quick Thanks!! To u ALL for yr help! (I'll have time tonight to answer back to individual advice as there's SOOO much great advice in these posts!) I'm NOT being tight- just think as I'm following RTA's process. I can still handle this myself. I have used PM's before, AND I CERTAINLY WILL use one from NOW for letting this house! But Ive already given him his Breaches, Notice to Leave! in correct order & timings - I feel like he'll think I'm NOT able to do this & he's winning if I hand it over to someone else now! I dont want this BULLY to feel like he's won, as I think he's bullying me because I'm a woman! (Im sure the ladies here will understand this). I know I shouldn't care what he thinks AT ALL but I'm not backing down now & retreating, about to call the Legal Service Centre here about urgent order to leave from QCAT. Will get back later! And yes! I'm looking later today at PM's for here -Central Gold Coast areas!

    I think you are letting your ego get in the way of common sense.

    Who cares what this tenant thinks? He seems to think you are a pushover, and probably has figured out that he is up against a relatively inexperienced landlord.

    Even involving the RTA will not help you much against a wily tenant who knows all the loopholes and which strings to pull to create more delays. Yes, you will eventually prevail, but at what cost, both financial and emotional?

    Another advantage of engaging a PM is the ability to have this tenant blacklisted which will affect his future rental opportunities. Of course he may already be blacklisted......

    Swallow your pride and get a professional PM to deal with this tenant.

    Even I who self manages, suggest you do what most here are saying.
    You have gone into this with zero knowledge of how to self manage.
    Now you are in a pickle, get out, fast!
    I also agree with Marg above, that you are getting personal about it. That is a giant NO-NO.

    Take the advice that you have come on here asking for.

    As another who has always self-managed, if this was the situation I found myself in, I would pay a PM to sort it out for me.

    At the very least you may want to consider getting in touch with a PM to advise you through the process, it can't hurt to have someone holding your hand, even if you're intent on seeing it through yourself.

    Hello Lolly legs!
    Ok,
    start planning your next steps.
    1.Have you arranged with a locksmith to change the locks for when the minute arrives that he has gone?
    2.Have you had a chat with the local constabulary to let them know?
    3. Have you got a good Gin and tonic planned:cool: for when its re let, correctly and with due process?

    I understand this feeling. Anyway, you have to do what works for you. It sounds like you have considered it carefully and you don't seem to be in any actual danger.

    Incidentally, it may sound like forum members are being judgemental - but they are just responding to your comments in the OP that you are scared.

    If you can be scared and still keep pushing through - then that's quite a good experience for a woman to have.

    Hi Again! and once again thanx for yr help & advice! IDO appreciate it. Just to answer some comments here, I've successfully self managed this house for 10 yrs without ANY probs till this creep moved in. It was a holiday house on Stayz, for 4 yrs, then 2 lovely tenancies that stayed 2 yrs & 4yrs!! BUT I"VE NEVER come across a creep like this! And I did the dumbest thing of believing he would pay the bond, after he moved in!! Its only got worse since then! So to answer some advice- Yes !! I'm now going to the Police with the messages, be interesting to see what they advise (Spoke to them on phone today & they said "come in, tell us about it, & we'll listen to his messages!) Got appointment for legal help next week too about going to QCAT for a urgent order of Termination/ Possession, AND I DECIDED I'M GONNA TRY TO GET A PM TO HELP WITH THE NEXT ACTIONS!! WHOO WHOO!! Which starts on Tuesday, giving him the next "NOTICE TO LEAVE, RENT ARREARS- 7 DAYS". Sooo today I delivered him another copy of yesterdays one (that he said wasn't in letterbox). Hand delivered it AGAIN (adjusting dates), txted him -said another was in letterbox! He txted back " there's nothing in letterbox AGAIN, & next time send notices via Australia Post". So I txt back "You are not even at home so how would u know what's in yr letterbox???" He had no reply to that!! And I told him about my witness in car (true). He's gonna be VERY pleased tomorrow as he'll also get the EXPRESS POST REGISTERED MAIL copy of Notice to Leave (Dates adjusted for posting). Hopefully he'll get knock on door & sign for it, If he hasn't by late arvo I'll tell him "You might want to look at it as its NEW Breach notices" - it's not- but hopefully he'll fall for it! Any way as I said I'm going to try to get a PM to help with upcoming notices to him /inspections / QCAT etc, Because - YES YR ALL QUITE RIGHT- It'll be easier having some help dealing with this slippery arse*&%%^!! LOL Must say cant wait to be calling up the locksmith! Waving goodbye!

    I agree Joynz! It is a good experience to push thru- that's why Ive been doing it AND to teach him "you can try what u like but I'm not going anywhere Buddy.. You ARE!! .. LOL" He needs this lesson!! for all the women he'll have bullied in the past! Thanx fr yr kind encouragement!

    Thanx for yr thoughts Seaford!:)I'm looking forward to changing those locks. Also ... yes! Had quick chat to Police today, will be going in to see them soon -might wait till Tuesday when he's got next Tuesday's Notice To Leave- 7 Days (expect him to shoot his mouth off on voicemail then, more to show the Police). Actually getting less scared of him -just getting ANGRIER! But letting it ride... with the help of a nightly drink now! !!! :rolleyes:
