Granny flat and studio

    Hi all,

    Just wanted to find out if this is in fact legal... We're looking to build a granny flat... In the process of looking for builders we found 1 that said they can build 2 bedroom granny flat plus a separate 1 bedroom self contain studio with bathroom and kitchenette.. Apparently this is legal and I can see he has done this for other clients...

    Anyone can confirm?

    You will have to ask your council about the particular block of land.

    Illegal almost 100%

    Although and out building is legal it cant have a kitchen and so on.

    I check this .

    In NSW subject to meeting the conditions in the Affordable Housing SEPP, you can have a secondary dwelling (granny flat). You cannot (legally) have a 3rd dwelling.

    As long as the studio is 20m2 it can be built as an exempt development - you are permitted two of these as long as they meet the requirements.

    We did this (and had a Somersoft thread on it) where the two "sheds" were joined.
    As long there is not a hard wired kitchen I understand that can comply.

    We may do a granny flat in the future and don't think the studio impacts on our ability to do that.

    I had one council knock back a studio because it had a kitchen in it. A few slight mods and then it went through (from memory, on the plans changing "kitchen" to "lounge" and removing the cooker, sink stayed). Each council, and sometimes each council planner, will have different hoops to jump through though.....

    Illegal, but done anyway. Studio won't be approved with kitchen - you'd add that in afterwards. Also the space is tiny, 35m2 under the NSW SEPP.

    There is a way.

    Think normal looking granny flat.

    Walk through the front door. But now there's a door to the left, and one to the right.

    One side has a full kitchen, other side has a wet bar. Each side has a bathroom.

    So tehcnically it is a 2/3 bed 2 bath with one front door, a kitchen, and a wet bar.

    It's a grey area construction, it will comply with BCA, just not necessarily liked by Council.

    The owner of this house has done it a few years back, 2 granny flat at the back. NSW location.
