Exchange while overseas?

    Hi there,

    Question for the solicitors, what are the options to exchange on a property sale while one party is temporarily overseas?

    I'm not a soli but we are doing more and more electronic exchanges via email these days.
    Also we sign on behalf of clients regularly using a limited POA.

    Shouldn't be an issue - would be similar to interstate exchanges.

    You could do a Suitebox meeting and sign a contract that way. It even records video of the parties making their respective signatures. For a legal adviser and buyer its great evidence of the making of a contract. A signature can also be your "mark" and need not be that on say your license. Can also be witnessed. Even in some cases at the same time.

    Signatures can be added by a scanned signature or a touch device. All that is needed is a webcam enabled device OTHER than a iphone.
