Conveyancer to sell a property?

    Hi all, I’m about to sell my first property.

    Is there any need for me to have my own conveyancer or solicitor?

    In NSW you will need to have a sales contract drafted as a start.

    If you:-
    • Can prepare a Contract with all the necessary legal disclosure documents;
    • Can understand the legal implications of any changes requested by the Purchaser's solicitor;
    • Are able to facilitate the transaction using an electronic settlement agent such as PEXA (if that is a requirement in your jurisdiction) or otherwise know how to request an exemption from the mandated use of electronic conveyancing;
    • Are comfortable not having someone that you can sue for professional negligence in the case that things go horribly, horribly wrong.
    Then you can certainly act for yourself without the intervention of a solicitor or conveyancer.

    It's such a tiny price compared to the capital. Even if it wasn't a valuable asset I would still pay someone else, it's still can be a very painful process. Besides, who wants to have to spend a month or 2 talking to lawyers - ugh
