can someone clarify grannyflat laws in SEQ

    I am getting confused by this - I know places like the gc you cannot rentout a granny flat on your PPOR property, but what if you were renting out the main dwelling as well? - if this is also not allowed, then what is the difference with renting out a duplex? is a duplex structured differently in terms of titles etc which makes it legal and different from other forms of dual occ like the granny flat?

    Each council is different, ask the relevant council.

    Also yes, duplex is different, will have own title, like a semi, in most areas.

    SE Qld is a big area.

    Quite a few different councils, each with its own rules and regulations.

    A duplex, townhouse or unit has its own title and can be separately owned.

    By definition, a granny flat is an additional dwelling on a residential property so cannot be sold or owned separately.

    okay that makes sense, so someone who owns a duplex would own it in 2 titles and can rent them each to separate tenants no matter the council.

    Duplexes and units don't necessarily have to be on a separate title.

    We have a 3 unit block and also a duplex in BCC - they are registered with the council and legal.
    However they don't have separate titles and we cannot get separate titles for them.

    However we can rent them separately and all the utilities are separate. I think this is a historical think as I doubt you could get permission to rent them separately today without complying with the building codes.

    To answer the original question - whether you can rent separately is about what council has permitted.

    It is possible to own a duplex pair on one title however. One lot of rates etc.

    I want to build a Fonzi unit over the top of an office and double lock up garage of an existing IP on the Sunshine Coast.

    I meant they would need to be separate titles if the council didn't allow you to rent dual occs to different tenants like on the gold coast, I think nsw it isn't an issue though.

    BCC in my post was Brisbane.

    Plenty of approved dual occs on the one title. Mostly older ones I guess.

    granny flats are no go in BCC. Depending on setup you may be able to get through a loophole at present but it is about to close.
    Logan works as does Ipswich.
