Can PM terminates contract on the same notice date?

    After many weeks of frustrating to following up maintenance works with PM, he emailed me a notice of contract termination, effective on the same date.

    I wonder if PM is legal to terminate the contract on the same notice date.

    This PM is one of the members in Somersoft. He did the job well at the beginning in 2012. However, his service and communication became very bad in the last 2 years. Many calls and emails are sent and followed up. He never actively or proactively to communicate the problems to me. I had 3 properties with this PM then had a new PM managed 2 of them. Now I decided to move the last IP to a new PM.

    So you're unhappy with the service level and worried about them cutting your ties? This should be a good thing - you're free to find new PM of your choosing.

    Is PM legal to terminate the contract on the same notice date? It sounds not fair as I have to give him notice in weeks before terminating the contract. I also need time for handover to new PM. Who will collect the rent when no PM appointment?

    What does your management agreement say?

    Tell them you will be there between 12.30 & 1.00 pm to pick up the documents.

    The same termination periods that apply to you, apply to him. Check the agreement. In QLD, for example, on any agreement made post December 2014, we have a fixed 30 day termination period that can be ended sooner with mutual agreement.

    If this is the attitude he's taken, you want to get your property into safe hands ASAP because I wouldn't expect him to lift a finger even if you did force him to wait out a termination period.

    Appropriate notice needs to be Given either way according to the terms of the contract

    unless youve agreed on different terms it should be 30 days standard,

    in fact I took an agent to court when one of their young agents cracked the ***** at the job because it was too hard, and said keys are ready to collect for this property by COB today,
    (I had 5 properties managed by them), they then proceeded to raise their rates effective immediately by 3%)

    this incompetence worked very well for me in court,

    if the agent, surprised your agent is on here with a good rep, if they think they cant terminte effective immediately, its Property management 101

    however, you should use the notice period to find someone else, and make sure other people know about the crappy job they did

    I got an email from his office to correct the previous email. So, that termination date is now correct according to the contract now, same as numbers of days I have to notice him. This PM is not competent in property management and customer service at all.
