Amendment to the RTA - WA

    There is a bill currently in parliament with respect to the Residential Tenancies Act. The amendments include lessor’s right to entry, abandonment of goods and services.

    In relation to the services, the proposal put forward is to allow serving of notices and documents electronically subject to the consent of the tenant/agent/lessor.

    Currently, the most common method for service is by post, where you will need to allow 2 - 4 days for postage depending on which court deals with your application. The new amendment means that you don’t have to count postage time and this will allow you to apply to court/take next action immediately once the notice expires. That’s my reading of the particular section and I am in the process of getting clarity for those interested.
