Lawyer needed in Perth/ Tenants vacating the house

    They wrote a letter saying they abandon the house, 4 months before the end of the 12 months fixed lease. So yes, they will stop to pay.

    write back and say they have a lease for 12 months and you expect to be paid until the last day

    Well, that is good for you, a written admission that they broke their lease. Should be easier to support your claim either thru the courts or perhaps landlords insurance(?) if you have it.

    The tenants can pay the lease break fees and leave. it’s just 2 weeks if they lived over 50% of the term.
    Ending a residential tenancy.

    tenant is playing tough guy to scare you off, i think you could get them for all the remaining lease term as people say.. if they are saying it wasn't habitable though it raises some flags, decent PMs in Perth are at pains these days to make sure everything is 100% as i guess if a places turns to junk tenants can push back. but if all defects were fixed then its a non issue

    we had something similar a long time ago. property market and rents were down though and we had to get a lower end tenant in, it was someone from overseas on the lease, they were no problem then they wanted to go home due to family reasons with 4 months on the lease. from what I recall the PM held the bond because they claimed they had no money. it was put for release and so it was empty for a week or two and new tenants moved in, old tenant paid up until new tenant moved in and we kept a good portion (maybe all) of the bond. not sure how legal it was but it worked as tenant could have easily just left the country. in your case it could put a bit of stress on you if you drag it out.. so either push for what is legal or chalk it up as a learning experience.. also maybe look for a new property manager once its all over
