    Hi all,
    Trying to get my refinance documents sorted before the working week.

    Can an adult family member who is not on the deed be a witness for a Mortgage NSW signature when refinancing a loan?

    Who is an 'eligible witness'?
    From 1 November 2011, anyone witnessing a person's signature on a dealing, application or caveat to be lodged for registration at the LPI must be a person who:

    • is at least 18 years of age

    • is not a party to the document being signed, and

    • has known the person whose signature they are witnessing for more than 12 months or has taken reasonable steps to check the identity of that person.
    If the witness has not known the signatory for more than 12 months, the witness can check certain types of identification documents to satisfy the requirements (eg, current driver licence, current passport or an expired passport (expiry within the last 2 years)). A witness who does not satisfy these requirements may be subject to a fine.
