Windows in pre1974 strata lot or common ?

    My older apartment has a faulty window mechanism, it is a window on a wall facing outside of the building (ie. its not in between balcony and inside).
    Strata says the repair costs is the responsibility of the owner and not strata as pre 1974 registered stratas deem this to not be 'common property' based on the centreline rule back then.

    Anyone had experience with this before ? Is this right ? The apartment block has had a few window repairs in the past which was paid by strata, but now they've come back and said that was an error.

    And if these walls are lot property, then can't the owners change their windows however they want and/or who pays for windows external cleaning, who pays for window safety inspections etc ?

    is it possible to put in a bylaw to change this to the current definition of common property ?

    So there's a precedent.

    "Ask" your strata committee to get this repair addressed in a reasonable time, and if they don't, schedule a Fair Trading Mediation.
