We have a new tenant whose one year lease in Qld is up in two months. this guy has been a nightmare with constant maintenance demands. He paid $15 pw over asking to be allowed to have his dog. If we want him out, can we up his rent with two months notice another $15 pw/ tell him we are moving back in and he has to leave/not offer him another lease? we are in dispute about the water bill, could he take it to tribunal and say we were vindictive?
If you have a good PM he/she will know the Resi Tenancy Act in your state and will be able to advise on each one of your questions and even formulate a plan of action, on your behalf.
If you want to end the tenancy - Form 12 (without grounds) at least 2 months notice, not before the end of the current fixed term tenancy date ends. If you want to keep the tenant and offer a rent increase, you need to give 2 months notice, if the increase could be considered excessive (which he could dispute at a later date) but he is happy to pay in consideration for being allowed to have a pet, simply draft a basic 'new weekly rent amount' by mutual agreement and get all parties to sign. To remove all doubt re: water billing, just pay the small amount to have a plumber attend and issue a water compliance certificate. Also, while we're talking compliance, make sure you have your smoke alarm compliance certificate on hand, the tenant is required to receive a copy at the start of a tenancy and the compliance checks have to be done annually as well.
Hard to make a judgement with the level of detail given. Some "picky" tenants can be a sign that the property has been run down by previous tenants who didn't bother reporting maintenance items and/or PM who didn't inspect properly. The Y-man
I don't think the $15.00 dollars a week will sort out the problems,and unless the plumbing is set up right for water saving then it would be a waste of time and money .. I would just step back let the PM do what they do and give notice now ,and get a black belt in nocando ,it teaches you to step back and let someone on your pay list to deal with the problem..
What are these maitnence issues he is demanding ? are they issues that actually do need to be done ? I agree with Y-man if this is the case, you've no doubt had tenants that didn't care so never reported maintenance and now the place is run down . Now you've got a tenant and he wants things fixed and in working order like they should be. This is why tenants hate landlords too , they are not " picky' they just want things fixed that should be.
