Victoria: neighbour's tree causing damage

    Our neighbour's tree is right next to the fence and I think it is causing damage to the concrete slab and the wall of the house. Also the branches are growing over the fence head high as well.

    Who is responsible for the maintaining the branches and damages it causes?

    This is a private rather than a Council matter, so have a chat with your neighbour first.

    Some advice is also available on public law sites such as the Victoria Foundation and the Dispute Settlement Centre of Victoria

    In terms of the branches growing over the fence, you're entitled to trim it back in line with the fence (on your side).

    Had a similar issue at Middle Cove house regarding roots. Suggest to look at the type of tree it is ie some have root systems going vertical/ down while some spread horizontally also look on their side for any damage which may be caused by the tree- if there's damage then it looks like tree is problem and neighbour will want to fix for his benefit as much as yours,
