Transfer investment property to super fund

    9 resi properties would be very difficult (ie almost impossible) to be classified as a property business. And if it was there is a complex tax issue to encounter. An inspecie transfer may be allowed by state law but the ATO has a large CGT issue with the issue if the taxpayer tries to use the small business CGT concessions.

    This is a complex area and legal, tax and financial advice would be suggested.

    Hard to see the ATO accepting them as a boarding house if they are not registered under state law.
