QLD Townhouse gutter repairs

    Hi,

    In advance, any advice appreciated. Thanks.

    One of the neighbouring townhouses on the lowside of mine has complained about water ingress through the retaining wall from my back yard.

    The body corporate has had plumbers out to inspect. It appears a blocked stormwater running down a few properties has caused this. I understand that as this is a shared easement that the costs will be footed by the building fund?

    My real issue is that while the BC's plumber was doing the inspection, he noted that my gutters had rusted and concluded that they were contributing to the water ingress to the townhouse behind mine.

    Can the BC force me to repair the gutters? (they claim I have a duty to)

    How can the plumber conclude that water ingress is being caused from the gutters from my roof? We've had no rain for many months!

    I'm very suspicious as they have recommended the same plumber to quote me for repairs.

    Many thanks for all suggestions regarding a course of action. My current strategy is to ignore the body corporate request.

    Get a quote from another tradie.

    Damaged gutters could be damaging your prop too.

    Are you in a townhouse as well? Gutters would be BC responsibility

    Gutters should also be BC maintenance responsibility

    My townhouse has a shared wall with one other townhouse.

    Each townhouse has it's own lot area ie front and back garden.

    The BC mentioned this

    "under a Standard Format Plan which your property falls under, the maintenance of gutters/downpipes is the responsibility of each owner".

    I found this. So it looks like I'm up for the cost.

    But what I don't understand is who decides when I have to do repairs.

    Must be a qld thing..
    A quick way of working this out would be to ask "how much are your strata levies" ?

    We have a villa unit in a 4 pack and the only thing the OC covers is the driveway. Everything else is maintained by owners.
