    Hi All,
    Just wanted to get feedback on QLD HIA contract for a builder to claim extensions of time for inclement weather (beyond number of wet days specified in contract) ?

    I’m aware of section 42 of Schedule 1B of the Queensland Building and Construction Commission Act 1991 limits the circumstances in which a builder can claim an extension of time to only those where the delay was “not reasonably foreseeable” and “beyond the reasonable control of the contractor”. I believe this act takes precedence over any contract as this is the legislation the builder is working under.

    Unless the weather is beyond normal seasonal rainfall or was not foreseeable by the builder before entering the contract can the builder claim EOTs ? (QLD typically has a wet season over summer and Lanina weather pattern has been well publicised so builder should have allowed for this)

    I would appreciate feedback from any construction lawyers assume this would come up quite frequently.
