NSW Tenant refuse to pay rent!

    So, you are really desperate, but you are still contemplating illegal actions to remove the tenant, like lock changes & cutting off the water? You still haven't told us where this property is, so that someone can recommend a good property manager for you.

    hi guys, I am the op and I want to update the new situation. I have written a formal letter and send to her two days ago saying she has to pay or bear all the consequence etc, she ignored it. Today I went to the tenant's home, just checking did she abandoned the apartment or not.

    We met again and she called police. The police came and separate us, the police mentioned that it is legal for me to go to my tenants' place (with notice). I can not kick her out. I have to bring this to Fair trading.

    My question is: The agreement we signed is not a fully legal document but I kept the history of her sending this agreement to me, which can be useful at court... But hopefully she can leave soon..

    good on you for updating,

    What a piece of work of a tenant you have....

    best is to get her out as soon as possible, and legally hopefully,

    shes gaming the system and you, so I wouldnt accept any form of payment plan etc. but if tribunal orders it, you dont have much option

    Did you lodge the bond as others advised you? The tenant can cause you quite a lot of trouble if you haven't done that - it's not a small fine.

    You asked for advice and were given it, yet you decided to ignore the advice & send a letter to the tenant.

    Of course she did!
    That is correct. You can't just kick her out, there is a process to be followed.

    That is not a question.

    PLEASE, please, before you make a bad situation worse, GET A PROPERTY MANAGER, and don't try to self manage unless you know what you are doing. There are laws and processes that must be followed. Trying to do it yourself to save a few bucks is very much a false economy.

    Oh, and LODGE THE BOND before you get yourself into anymore strife.

    Sounds like landlord from hell, no wonder they called the police

    Nah, the guy on whingepool that wanted to sue his tenant for mould caused by the gutters not being cleaned, objected to $1900 to replace a leaking hot water system and asked the plumber for a "temporary fix", and thought if he let the tenant go onto periodic so "it's easier to kick them out if they complain" gives landlords a bad reputation.

    They closed it because it turns out someone who thinks that they can sue their tenant for not cleaning gutters and is shocked that hot water is actually essential doesn't listen when told otherwise.
