Taking photo shop a little too far....

    I agree. I don't think it's a photoshop job. I think it's a 'creative' angle shot. The agent is taking the shot from closer to the house and lower, facing upwards. This misses the tank completely in the background.

    Right, I'm saying that just because it's not Photoshopped doesn't mean it's not misleading. I think that it could land the agent in legal hot water even though it's not Photoshopped.

    If these people had been looking for a year then they would know the area very well. The water tower is visable for at least a 3km radius - it is actually very pleasant and most of the houses around it are very nice (see the house next door) personally it would not bother me living near the tower. It is very clear from google maps how close the tower is. While they really should have shown the tower in the photo, the house is in one of the hilly areas of penshurst and it wouldn't take much effort to block the view out from the street level as most of the houses are elevated from the road. Finally house prices have jumped over 40% in the area, this house is very close to the village and train station what were they expecting with a 1 million price tag in a 1.3 million dollar suburb ?

    I personally see no issue with it. As stated above, if you know the area then you know that there are two towers in that location so I am on the agents side.

    Does that now mean that a busy freeway needs to be in the image if a house is located on one. Or the druggie neighbours or howling dog?

    It's not a black and white issue; it comes down to a "reasonable person" test. Would a "reasonable person" consider it misleading to lie on the ground to take a photograph that excludes the water tower? I think a court would likely find that it is misleading. But maybe they wouldn't.

    I love the ads with the photoshop'd red skies and clouds where they use the same sky arrangement for every angle. Doesn't half give it away when the photo changes but the sky doesn't ;-)

    They may have hid the tank behind the house, but they still photshoped the sky as the have removed the power line running to the house as well.
