    Linky and have a read of S109c.

    No Certificate of Occupancy = expensive mistake.

    @Scott thanks for the links mate.
    So does the existing property contract must include the certificate of occupancy ?

    Is there any way to check that before buying the property ?

    It's not a requirement of the contract but usually a requisition by the solicitor (which can be refused by the vendor if they don't want to comply). @Terry_w "requisition"

    Ah I see,

    So in this case, I will have to go to unconditional contract first and then ask my Solicitor to request it from the vendor's solicitor.

    Ask the council, call Sydney water, then it will crystalise.

    Up to you if you go unconditional first, I would not :)

    For some reason, Sydney water told me to log this case to Fair Trading ?

    Does anyone know if I'm on the right track by reporting this issue to Fair Trading or to the local Council ?

    Did you tell Sydney water your thinking of buying and what is the problem ?

    Ask the council if they know of any issues and if it is all passed and occupancy certificate issued.

    If your not in a position to buy & seriously considering it, I would not waste either parties time. If they sense your tyre kicking they won't do much either.

    Prob best not to report to fair trading at this stage. Why did they say that?

    if they have done what I think they have it is land minus demo costs + a bit more :)
