    On 18 April SSC submitted to State Planning an amendment to limit LEP in R2 Residential to two dwellings on blocks under 1200sqm. From May, staff informed enquirers that approval was imminent, discouraging builder-developers buying property under 1200sqm for multi development ( permitted by current LEP ) since it takes at least 4 months to purchase, prepare / lodge DA.
    Over 4 months has passed and amendment still not approved by Planning & Environment.

    No clarification available from media, SCC web site or Planning and Environment as to whether it will be approved in current form or when it will be gazetted into law.

    I have a 930sqm corner property which could carry 3-4 dwellings under current LEP but likely to be reduced to two townhouses under amendment. Does any town planner / certifier have info.

    Submit the DA under the current plan, they have no choice but to abide by tge existing and lawful use. It is too late once the new law is in place.

    Thanks SCM but not so simple.
    Architects quote 3-4 months to prepare DA for 3 TH & cost $30-50,000. If amendment gazetted before lodging, DA is non starter. As 75y.o. pensioner can't afford to loose all.

    The difference builder will pay for my property between 2 TH with granny flats attached and 3 TH is $350k.

    Hence need to know if State Planning will approve as is, require change or has approved or how long before it does. But can't get info from SCC or State Planning.

    Need expert with intimate knowledge or contact with SSC or P & E.

    I would ring around planners/architects/draftsmen in SSC to ask them if they have additional info or heard anything. With the right person, lodging a DA could take maybe 6 weeks.
