    Doesn't matter if you buy a place with an existing lease in place or not..

    If you don't move in ASAP you are deemed not to move in as soon as reasonably possible and thus main residence exemption will not apply.

    Lease or no lease, ato does not care. You will really need to break the lease and kick tenants out in order to establish main residence from purchase date
