Setback for a 2-storey house

    Hi
    If council development plan says that
    1. One storey building needs to have 3m setback
    2. Two storey building needs to have 8m setback

    Does that mean it allows a 2 storey building to be built with 2nd floor that 8m from back fence but 1st floor that is 3m from back fence?

    In most cases yes. Ground floor setback tends to be less than first.

    Is the upper floor setback the start of the living area or the start of the building ..?eg if you had a 2m wide balcony then is the entrance to the balcony setback 8m +2m = 10m?

    Generally the rules are quite complex and not just as simple as 3m and 8m back. As @Big Daddy says there are often allowances for balconies, minor projections, averaging of setbacks (ie 10m and 6m setbacks create an 8m setback) etc etc

    Does it say that's the rear setback? There are setbacks from all boundaries.

    In the Auburn DCP, setbacks are to the main building line, but some things like balconies and entrance portals can intrude into setbacks a little.
