S173 agreement - Any successful story in splitting the block in 2?

    I know it is a bit hard but feasible.
    Anyone was able to do it and if so which council?
    Looking to build a dual occupancy.

    Section 173 agrrements can be for a range of things, from how rubbish is to be picked up to restrictions on what you can do on the site.

    Only one dwelling allowed on the lot ;-)
    I heard sometimes you can get approval to do a dual however it is a bit hard

    Only allowed 1 dwelling, or not allowed to subdivide? There is a difference, if its not allowed to subdivide then you may be able to build two dwellings, but keep on the one title.

    If you are only allowed one dwelling, then you will need to modify or remove the s173 agreement. This process is similar to a permit process, but seperate. Talk to council.

    Another thing to look at, is if anyone else in the subdivision that created your lot (and probably created the 173 agreement) has built another dwelling or subdivided? Or are you the first?

    Hi, I am the first. The section 173 talks about the building envelope but not subdivision so I guess there will be a bit of process behind. I will be the first of 5 ;-) Thanks for your help
