Renting out house with an outdoor spa

    Hi, I am interested in a house that has a beautiful deck out the rear with a sunken outdoor hot tub/spar. Has all the permits pool fencing around it etc. However my friend has told me a footballer got in trouble a few years ago when a tenants child drowned in a spa even thought it had a fence up.

    If you have a spa if it has a pool fence and council approval is it fine to rent out?

    What was the nature of them getting in trouble? Was it proven that fence lock was faulty, fence too low etc...

    Individual circumstances would have been looked at and some form of neglect assigned.

    I think there was somehow a gap between the pool fence and the property boundary which was somehow being used as part of the fence.

    As long as you inspected it annually would that be enough... my friend was saying if the catch on the gate breaks say, and the tenant doesn't tell you and then something happens, it could still be your fault.
