REIWA building and pest clause

    For you guys who bought in Perth, do you often use the standard REIWA annexture wording that only covers major structural defects or do you write your own so it's "satisfactory to the purchaser"?

    It depends on the circumstances and your own risk appetite

    The REIWA annexure is nice in that it's quite clear cut but it is limited and isn't a free for all to negotiate a discount based on multiple minor things.

    So you need to truly understand what the annexure protects you again and decide if you want further protection to cover things like roof plumbing, failed water proofing etc

    Then weigh all that against how strong you want your offer to be in a competitive market. Some suburbs are so popular that you're competing against unconditional/cash offers so you'd be lucky if you even get the REIWA annexure let along a 'subject to building inspection being to the satisfaction'.

    if you want other items in the building inspection to be included then I highly recommend you talking to a lawyer about how to word that because there is no legal basis to prove 'satisfaction of the purchaser'. You could chose to ammend the REIWA annexure to include other items or come up with a solid clause to cover it.

    Thanks Westminster it is indeed a popular suburb. Wonder if a working order clause might cover partial minor defects ? Good enough I guess?

    Properly written that might do enough for you. Usually the REA would have a prewritten document that might suit you (with potential ammendments). It's generally called a Plumbing, Gas and Electrical Guarantee or Seller's Warranty and would state that items in those categories work.

    Generally you'd try and use that together with the structural warranty if possible but everything is a negotiation.
