    Hi

Can anyone recommend a JP in Sydney who can sign QLD mortgage documents? I have a client in the CBD trying to get a signature. Even the JP at the Supreme Court can't do it.

    Thanks in advance.

    Jen

Thanks, Jamie. Do they do QLD Mortgage docs? There are heaps of JP's around, but none of them can sign the QLD docs. Requirements are very different between QLD and NSW and VIC. I had the same issues myself in VIC...

No such thing as an average JP. QLD legislation I guess.

I've had quite a few signed in Sydney for Brisbane and never came across this problem.
Local solicitor or in house conveyancer signed the docs.

My JP in the nearby office was OK, he signed and stamp my QLD property document.
But for the Solicitor, I have to use the Solicitor/lawyer in QLD.

you don't have to use a solicitor located in QLD.

There's usually a JP in each station.

Any JP should be able to do it - I've had heaps of interstate clients purchase in QLD and have local JP's witness the mortgage doc

    Cheers

No. Only those that practice in this area. Some NSW solicitors can do conveyancing for QLD and vice versa.

He's been told by 2 JPs that they can't do it, something to do with not having the jurisdiction. Then contacted by a solicitor who quoted him $300 to witness it...

    you mean 'won't' do it,

Solicitors can't really witness mortgage documents without explaining them because of a recent case in which a solicitor was liable for not explaining something when he did the witnessing.

I've got mine done the week before from Stanton Library North Sydney.
JP did check with me though, if it is for a property in QLD. And then she said, "oh it's only the Mortgage documents".
So I guess there is something about witnessing QLD documents but apparently nothing special for the mortgage docs.

Call JP branch office in South Brisbane. They will probably have someone in their database.

Yes there are some Sydney JP won't sign mortgage document, not because they're QLD documents

I know Willoughby Council, the JP will not sign any mortgage documents. But the Supreme court in Sydney CBD, the Phillip St did it for me. Blacktown Library also did for me.

This list has all the JP.

Depends on their liability cover. Our lawyers are only covered for Vic, so can't conveyance for Qld IPs for example.
