Problem with real estate - do I employ a lawyer?

    It is your right to have someone manage your property. They cannot stand in the way unless fees are not paid and a lien is applied.
    Same for solicitors. Once you engage a new solicitor, the former solicitor cannot contact you whatsoever (solicitor's rules) and everything done through the new solicitor.

    I think they wised up and did the right thing but whinged no matter what.

    The question not addressed relates to capacity.

    Is the person you consider the PM licensed to provide PM services herself ? She was acting under the principals license NOT her own REA license. Your contract was with that licensee not her. You may want to ask for the keys to be given to her but she may not be capable of acting as PM in her personal capacity and the former licensee may be acting in your bests interests and have a obligation not to release keys to a person who is unlicensed, uninsured and perhaps unqualified (???)

    A employer may hold a right to take legal action if the former employee has engaged in conduct to steal clients. This is unrelated to your needs. They can sue Ms X or seek orders to restrain or even both if you go to her. This is fairly common and may indicate a degree of reckless indifference and unprofessional conduct. . You may end up with a new PM who faces a costly and problematic journey and this could affect services.

    IMO I would find a independent PM and cease using both

    Thanks for the heads up DaveM. It sounds like you have it all sorted now but just in case, I am more than happy to help out if you need someone to drive round there and collect and pass on.
    Honestly, what a carry on from the current PM !! No way to treat any client whether outgoing or incoming in my opinion. Kate

    You would hope that a PM that is decent actually has all those items you listed sorted out.
    A business is good because of its people - If you've found a PM you trust (or any other professional for that matter), follow them everywhere they go.
