    And after 6 months, a large portion of tenants would already be on TICA. TICA blacklisted tenants would become the new normal.

    But this appears to be just lies, when we see the Tasmanian legislation, that a tenant cannot be evicted for any reason, they don't have to prove hardship at all, let alone coronavirus related. I think the only part of this statement that might be true, is that the landlord is still expected to bend over backwards to fix stuff when a non paying tenant who might have been trashing the property and can't be evicted wants an emergency plumber. I wonder what punishments they might have dreamed up for the landlord that refuses to do such a thing? Is there anything written in law that the landlord is still required to fix stuff when the tenant refuses to pay rent?

    You could also try to break lease. The break lease fee would be only 4 weeks of rent anyway, not that much in the scheme of things.

    Would definitely speak with the PM and see where it gets you, if you’re still on a fixed term you may need to look at a break lease - but there are ways you can negotiate this if in hardship and can apply to VCAT for a reduction of a fixed term if the landlord won’t come to the party.

    I think income earning tenants would still pay their rent and do the right thing, I actually think the majority will. You’d be asking for proof they’ve been let go from their employer, applied for Centrelink (or not eligible), applied for super etc.

    Re TICA/NTD in Victoria you cannot list until the lease is terminated and under strict guidelines.

    Interesting - for some reason I thought I would be responsible for all costs incurred to the landlord until such time they could find a new tenant. I thought I'd have to pay for advertising etc. and if they couldn't find a new tenant, I'd be expected to keep paying.. Guess I need to re-read my rights and obligations.

    But this whole thing is just an awful situation for a lot of people. Its affecting people who had recession proof jobs, too - its a chain effect, and sadly Scomo is right, we're all going to end up doing some heavy lifting...

    Ohhh. Maybe. A friend was considering breaking lease and that's what she said. Maybe you are right though, but I would think to get you to pay all those costs maybe considered unfair given there's the pandemic.

    I wonder how LL insurance come into it, will they still pay up and chase after the tenant at the end.

    Your thought is correct in most cases hence your reasoning and would be written in your lease agreement. You could argue differently with your landlord considering the current social environment however I wouldn't assume anything other than what is written and signed in the lease. Any other breaks they may grant you are on an individual case by case basis.

    If a tenant couldnt pay rent due to hardship of covid-19 and landlord couldnt afford to keep paying mortgage can the lender freeze mortgage payaments? Is there any info regarding that?
    Thats what Europe is doing

    My understanding of this is that the interest is capitalized. Don't know for sure though.

    I am loosing my mind here.
    I own a property that I rent out downstairs. It assists me to barely cover the mortgage and child support, I worked for years to scrape together enough to put a roof over my kids heads. My renters are already kind of sketchy and I chase them for rent already though full time employed. I had intended not to renew their lease anyway in June. Does this mean I can't kick them out now, they have had multiple breaches of rent already. So what now I can't evict them, I have to pay their power and water bill, loose the house, loose the roof over my kids heads, or be expected to go further into debt to the bank. This is complete and utter EXTREMIST LEFT WING HORSE****! (Socialism at work)Soon as I heard it I found out who the brain child was... oh look they are a Greens minister. Of course. I'm sorry if I bolted out the gate so angry, but I'm set to loose everything I worked so hard for, and be on the street with my kids, because of dodgey renters who now cost me more money. I'm basically keeping 3 people PLUS my kids. I am so Angry! I just need to know if when the tenancy ends if I don't renew they have to go!?!?!? Cause I can 100% guarantee that when they hear this they will just stop paying... "Just because"

    Maybe calm down a little, because you might not even be subject to tenancy laws anyway.

    Rugerjim, when they do stop paying, can you close the electricity account or is it the same meter as yours?

    Is there anything else you can do to make the tenants life unpleasant without causing police attendance, given they live downstairs?

    If they are using your wifi, change the password.

    Also absolutely do not repair anything they want done. I certainly won't be if mine refuse to pay.

    This may be only sort of means we can use to force tenants to either pay up or get out.

    Tribunal being closed/busy will work both ways and we remain to see whether tribunal has any punishments they plan for us that they can actually enforce in addition to the free rent and allowing our properties to be trashed with no recourse, we are already forced to provide.

    @Rugerjim wait until we see what the various state government announcements will be about exactly how this will work.

    Are they living there under a formal residential tenancy? Or is this a private agreement?

    if we end up with squatting tenants who refuse to pay and no evictions would it be legal to turn off the water and electric to the unit?

    the issue here is you could end up with malicious damage if tenants decide on revenge???

    Just try not to overthink what will happen as until the Government sets it in stone then plan from that point and just look at the lease in place as it's never as bad as it seems..good luck..
