QLD Previous PM failed to hand over to new PM

    Hi all,

    Got into a dilemma at the moment.

    Long story short. Been with my previous property manager (A) for 4 months and during this period they leased the property out for me. I've now moved to a new property manager (B) in mid April however (A) still not giving any lease contract, bond lodgement, ledger or keys to (B).

    (A) now has receptionist saying they are in meeting 24/7 and has not called back.

    Questions:
    1) What can I do to find out contact detail of current tenant - they didn't give me any lease contract when the tenancy started.
    2) Is there a professional group or consumer group that I can complaint about (A)?

    All advice appreciated.

    Your new PM should be onto it. Are you chasing the lease and the entry report?

    They are onto it still. Potentially looking at Office of Fair Trading complaint.
    Not sure if other had any similar experience and suggestion.

    Who is collecting the rent?

    Is it being transferred to your account?

    New PM couldn't contact the tenant so tenant is still paying towards old PM.
    Funny the money is still disbursed into my account though from previous PM.

    Has it been 30 days since the termination notice was provided to your old PM?

    Initially they agreed to hand over 14 days later. Now it is definitely past 30 days (from date of notice).

    Got any of this in writing?3

    Your first step will need to be to ask for the complaints procedure of the old PM agency. You will need to lodge a formal complaint with them to get anywhere with Fair Trading or any other body.

    Contact the Licensee of the old agency in writing (get their direct email address) detailing the termination date and issues - they should understand the implications and be willing to resolve for you.

    Which says to me they are deliberately doing just enough to annoy and frustrate you without doing something they could get in serious trouble for like withholding the rental disbursement.

    Extremely frustrating but it does occur unfortunately. Going public via their social media channels to force contact can sometimes assist. I'm not suggesting you go on their FB page and just rip in, rather write what has occurred (be careful and factual) and request contact from them. Emails and phone calls are one on one but companies start to pay a bit more attention if these things are moved into a public sphere.

    Once the agreement is terminated, it's quite illegal for them to continue to collect, disburse and take fees on your rent!

    I would be making a complaint to the Office of Fair Trading fast!

    Some legal advice probably wouldn't go astray either- a letter of demand or similar tends to up the ante in these kinds of situations.

    This! Had a similar issue with a property I just purchased, old PM didn't hand over keys on the settlement date and held the tenants rent... Had to get the solicitor to give them a nudge..

    They never even tried to send me a Form 6 (QLD) When I notified them that I was in the process of purchasing it.

    You can contact the RTA for advice or the REIQ, however, I would be demanding that the principal of the business contact you immediately or you will take your property elsewhere. You have every right to have a copy of all paperwork but not the bond as this can have private information on it but definitely the tenant's ledger, ECR and all reports.

    You're not supposed to hand over bond forms to owners at all. However, they can have all other ledgers and information.

    It's quite standard procedure in Queensland and is backed by the REIQ, however, things may work differently in SA.

    I think you'll find privacy act is federal not state based
