PM Issue

    My issue is ancient history now, I only mentioned it as a warning of what to look for. If something's not right, it's not right. Don't believe the excuses! As I said earlier, the excuses sounded plausible at the time.

    Oh, of course they're not. And that's where the OP does have to do something. They need to call Fair Trading (or whoever is there in QLD) and make a complaint, CAV down here takes trust account breaches and missing money very seriously.

    At the end of the day, if a new PM takes over with poor records - they need to piece it together as much as possible and then start a fresh should there be no records. OP would then need to try to claim on insurance, if it's covered :(

    Well, I'm in the process of changing agencies, and the original PM has still promised to sort out all the issues. Hopefully things will sort themselves out, even if a little late.

    I'm very happy to hear this Rygor. Like you, I still don't understand how the PM can be unsure whether the tenant has missed payments or its their own fault. This in itself is a sign of poor property management. Surely it would only take half a day to work out where the problem lies.

    I would suggest that you also set a deadline for the PM's response on this matter (e.g. 1-2 weeks), as you may need to take this matter further within the business and possibly receive advice from the police.

    While this PM may be a regular and current contributor to this forum, I would seriously consider identifying who they are if it turns out that there is something more sinister is going on. This would be to protect others who may be new or already using their service.

    I don't understand how other individuals/businesses can be labelled as frauds/spruikers (which is what they are) on this forum but someone who is connected Propertychat remains protected? Just doesn't seem right to me.

    If you had've known in the first place, you probably would've avoided them.

    Seconds really, if all details are up to date. Just look at the property in the pm software and it shows what date tenants are paid up to. If it'd behind, take action on tenants. If its up to date disburse out to owner.

    Police is not the right avenue for these matters. I've already advised the original poster privately (and so has his new PM) - correct avenue is to talk to the Fair Trading equivalent in their state.

    They'll perform a proper audit on the trust account, and will determine if :
    - trust account has insufficient funds, ie the operators have been doing something untoward , or
    - trust account has surplus funds (from poor record keeping) and they can help trace where it all belongs and distribute accordingly.

    Worth noting both of these situations have potential legal implications. There's possibly other scenarios as well so perhaps unprofessional to speculate until further information is known. I will disclose that I know of other incidents via other channels involving the same agency.

    Good for me to know........ *knock on wood* ........ in case something like this pops up for me... :eek:

    Admittedly, I do believe property managers have to deal with a lot of cr*p given what they are paid and I don't want to jump to any sinister conclusions here either. (In fact, I felt a bit sorry for my property manager the other day when he didn't communicate a property inspection update on the same day. I was veryyyyyyyyy quick to point this out to him... but later found out the tenant was a no show o_O)

    However, hearing stories like Rygor's does anger me... but also serves as a reminder really about a few things, especially communication.

    Well, I would not be demanding a report be sent the same day.

    But you should also ask why they did not do inspection anyway, they notify tenant of inspection, if they are not there, you do it without them !

    PS I hate all these anonymous threads, where everyone has to guess, it tars any PM in QLD with the same brush.

    Hi Lil,

    I would ask the PM to reconcile with the tenant's bank statements and request a copy of the paperwork. I would as well meet the property manager to reconcile tenants payments with your statement, then you will have a clear picture who is holding the funds.

    Good Morning, I am also an owner and PM in my opinion the issue is no doubt a combination of the 2 points you have made, if you Property manager has their procedures in place then you you know if your tenants are in arrears on day 1, I would have a meeting with my property manager and if this cant be resolved consider going else where with my property, Hope this helps

    Totally agree with Lil Skater Poor records is no excuse they should be putting in the time to research and piece the information together and get on top of it
