NSW Partial Change of tenants.. no new information

    Hello,
    scenario
    Lease expires February.
    Appears to be only one of three original signatories in situ,
    agent asked for ID for new applicants ..
    Tenants propose only one of them to be on new lease.....o_O
    to date, nothing has happened
    any thoughts?

    What do you want to happen exactly? I have lots of thoughts, but they might not be relevant to sorting it out.

    thanks for asking me to clarify ,
    I want all the tenants to identify themselves , and sign a new lease.

    I'm not being facetious, but have you tried asking them?

    And if they continue to refuse, are you prepared to evict them?

    Form 12 Notice to Leave (without grounds) as sufficient time exists, if they want to stay they must all sign a new lease but first the new comers must submit application forms and go through the standard due diligence process and be approved etc so you're covered by LL insurance. If they don't agree but you want to keep them on, fall back position is one of them on the lease, the others are approved occupants only, (the one named party fully responsible), not the best if things go pair shaped as you can only drag one of them through the ringer, but it's better than nothing. Bird in the hand paying rent is better than two in the bush so you've got some thinking to do, hope this helps :)

    NSW is 30+3 for notice of eviction in February at the end of the lease-DO NOT allow them to go month to month where the landlord is at a disadvantage. (60+ for a price increase with new lease).
    I had a situation this week where tenants didn't want to sign a new lease as "they are going to buy a property mid next year".....sent them a 30+3 notice to vacate at the end of the lease in Feb along with notice of access for 2 Saturdays in January for access to show to new tenants. I expect a phone call any day asking for a new lease.....if they don't then plenty of people will be happy to rent a nice clean modern apartment.

    Its real simple......advise the PM.....ask to be sent a copy of the notice.

    We are investors risking significant assets, its not unreasonable for landlords to ask for all parties to be on a lease.

    Thank you for your questions and suggestions!
    1.Yes, I have asked them to identify themselves.
    2. Yes I am prepared to evict them.
    3.I want to be covered by my Landlord insurance policy!
    I want do my 'significant asset' property to be returning me what I am due.
    Also the lease states 3 persons, apparently there are more than that....

    30 days notice plus four days postage has been served.
    The group wanted to stay together... now they are looking for new flatmates... Next week it will be something else.
    I will be advertising it for lease, with inspections late January.
    The place is in Sydney, walking distance to 3 Universities, etc etc.
