    Still not getting the point. The punter has signed a contract to get optima to build them a house, and that is what they get from my reading of the article. Of what concern is it to the punter how optima gets the house built?

    That said I am happy to be corrected, as maybe I have missed the point entirely.

    There's clearly some misrepresentation going on here. There are perfectly legal ways to do this properly, but I guess some people just can't help themselves!

    It seems to me that the article is in respect of a punch up between an owner and a builder, with a degree of uncertainty of optimas role in bringing the parties together.

    I'm not saying that optima is an inoccent party, but it is not possible to draw an adverse inference against them from the article posted

    "Optima “forges” progress payment invoices on the builder’s letterhead and sends them to the financier for payment, remitting to the builder the lesser sum it is obliged to pay under its own contract with the builder."

    I'm pretty sure they're not innocent....
