    Hi

    I'm having trouble finding the calculations for open space levy - is it 5%?
    This is for Knox council and Maroondah council - Melbourne

    Best bet to call council and ask them directly

    Should be circa 5% of LV though - as a general rule however will vary.

    Also need to clarify what type of development this is for... some levies aren't applicable depending on the development, i.e. duplex

    The subdivision act states its 5% unless otherwise stated in planning scheme. Check out planning scheme clause 52.01 - knox below.

    Note it is not applicable on two lot subs, unless council believes the two lots could be further subdivided, then it will (may) still be applicable. This stops someone from doing a two lot sub, then doing another one a year later to get out of paying.

    There can sometimes be arguments to pay a lesser amount. The council must use the money generated for public open space projects, if they dont have many projects then they may accept a lesser amount. Speak to your planner/surveyor. Also, some councils accept less on smaller developments (3 or 4 lot subs).

    Its 8.5% for Knox. For Maroondah it used to be 5% but best to call them and find out.
