    This could go down as criminally negilgent....particularly if the have phoenixed before. The guy is heading for the bog house if he has not fled the country.....some of the engineering and architects reputations are going to get dragged down in the mud. This will give councils ammunition to drop height restrictions....

    We have no idea yet where/with who the fault lies, so this type of blaming is premature.

    Word on the street is that @datto was on the first flight out..eyewitnesses reported only one passenger first plane out from Sydney airport, had bushy hair with a comb stuck in it, arrived in a beat up Holden, was wearing sunglasses inside the building dead of night....destination: unknown. First class, one way, non refundable ticket.
    Hmmm...

    Well....that sort of movement can mean only one thing....the railway (happened to a unit block near Lane Cove) or they took short cuts.

    Based on what I see on Australia....corporates are downright cheap. This sort of mentality is causing a lot of issies with new buildings. I read something like.....40% of new builds in Sydney have building issues. That is far too much.....

    That was the boring for the Lane Cove Tunnel - still waiting for the train/metro/light rail in Lane Cove.

    Whatever the cause, irrespective of any remediation works done, or any engineer declaring it safe, I couldn't live or sleep wondering. I mean if it's happened once...

    Will be interesting to see if people feel so unsafe even after the “fix” that they start renting out their apartment instead of living in it themselves.

    Some cheap air bnb for sporting events? Could see a few ending up being used for adult services. Really feel sorry for all the residents, always questioning safety of building going forward, also the likely loss of value and possible massive strata costs in the future

    For that number of units to be unsafe ,then that building's environment isn't safe or secure or predictable any more,and as all tall building's move some over 500mm in high winds ,which are rebalanced from one side to the other and don't crack ..

    @Someguy - insurance companies maybe but bit valuers. They rely on tangible evidence bit some probable maybe on a 1 in 100 year set of graphs.

    In latest news , all the residents are being told to vacate the building again as the company and investigators prepare to go in and do a comprehensive investigation into the cause of cracks on the 10th floor , and the investigation could last up to 10 days.
    Not nice for those planning to spend their first Christmas and New Year in their new apartment, or had it rented out for the busy Christmas/New Year period

    In a case like this, if you're a tenant are you entitled to walk away from your tenancy?

    I would assume you are entitled to break lease. I don't believe it is ok to leave in premises that are deemed unsafe. Fairtrading is the best place to get an answer to this question.

    A definite maybe.

    Cl 7 Deals with rent reduction If property are destroyed or become uninhabitable
    Cl 8 Raises the issue of rent reduction. Rent reduction doesn't necessarily arise If the property is uninhabitable (rent reduction is by agreement)
    Cl 18.1 Provides that the premises must be fit to live in.
    Cl 36 relates to the mitigation of loss.

    The tenant will need to breach the landlord for uninhabitable premises and seek to terminate the lease by agreement.

    What a nightmare for a property owner. I can't see how you would be able to sell any of these units now or even rent them.
