[NSW] Payment of S94 on a S88 instrument

    Really specific question i was hoping to get an answer to from Town Planners and developers in NSW.

    If I were to subdivide with approved plans via a section 88b (below minimum lot size) would the S94 contributions be payable on approval of the subdivision, or certificate of Subdivision.

    Alternatively, when you enact a sub division with a 88b, does the subdivision get certified before you build, or only after all the requirements of the DA are met including build?

    Is this a new development?

    S7.11 (formerly S94) contributions are payable prior to issuing of CC, hence prior to construction.

    After all the development consents are met, so after construction is complete.
