Notice to tenants - nsw

    Hello!

    We have a property in nsw where the tenants are currently on a 6 month lease. We are wanting them to vacate at the end of the lease. The PM has advised that we would need still to provide the tenants with a 90 day notice for us to have them leave at the end of the lease.

    Reading the fair trading info, I was of the understanding that by being on a fixed term, it should be 30 days?

    I'm hoping to get some clarification before we decide our options with the PM. .

    Any help would be appreciated!

    Definitely only a 30 day notice provided it is served at any time before the end of the fixed term and the earliest termination date is the lease expiry date.

    I'd get your PM to have a 'little' read of the Act and the Lease. The laws have only been in play since 2010 so maybe the PM isn't up to date with the rest of us as yet.

    Thanks @Phoenix Pete and @D.T. .. shall have a chat with the PM sometime this month. I'd like to give the tenants plenty of time and opportunity to look for another property, but there's a fine line :) ... Cheers!

    You've read it correctly - you can give 30 days notice at any time up to the expiry of the lease, beyond that it would be 90 days if they're on holdover.

    You advise them to vacate giving correct notice.....you shpuld change PM if they do not know the rules.....or if they are playing dumb......

    90 days is when there is no fixed lease and on week too week....
