New Tenants

    Hi,

    My property manager has recently leased out my property to her cousin. I have requested some details re the new tenants but now he is saying that due to privacy law, he cannot disclose any information about the tenants. What are my rights?

    Also, if we had gone through advertising and open house, we would have received applications from potential tenants, wouldn't I be involved in vetting the applications and select a tenant?

    Lots of agents dont understand privacy law. If you were a 3rd party requesting the info then sure i'd understand but they're actually your tenants and the agent is just facilitating things on your behalf. I'd ask for a copy of the application - there's nothing on there that would be private anyway - only info you can use to ascertain if they're suitable for the property - eg income, family size, pets, type of jobs they do , previous residences, etc.

    The above is a seperate issue to your 2nd paragraph and treated seperately.

    If the property wasnt advertised to market, how do you know its at market rent? Forget for a minute it was to someone the PM knows (as thats another issue in itself), if they've rented it below market then i think they've done you a disservice there as well.

    Thank you, I had another property manager who is a friend of someone I know visit the property and he has confirmed that the property has been rented out below the market rate.

    Did you approve/accept this tenant?
    Our most recent experience - ascertained current market rent (agent advice and own research), property advertised, open home conducted, applications received, shortlisted appliants (a small blurb on each) sent to me for final selection and approval.

    I believe you own all the paper work associated with your home and should have clear access to it, You could always tell the RA that you'll sign a confidentiality letter stating that you wouldn't pass the information onto anyone outside the RA.

    How do you know the tenant is related to the agent? Why did you agree to it?
