Hopefully your PM can see that it's in their interest to see this tenant out the door.

The tenants are being stupid and unreasonable, and it's entirely their fault for not looking and taking the generous gift of a new set, there's more to it obviously.

I simply cannot believe a tribunal would accept that providing an induction cooktop is not "providing an essential service", especially seeing they are being offered a set of pans that will work with it.

Electric, induction and gas are pretty "normal" these days. It's not like you are asking them to cut timber and stick it in a wood burning oven.

    I still say "ridiculous".

Induction cook top is a premium feature and your PM should be marketing this fact :p

    Loving this thread to date:D
Can't wait to see how it evolves (and for the next twist :p)
    Some great responses also ;)

There is always two sides to a story, having said that I find myself wondering why there isn't a poll, as my vote would be for "THE TENANTS ARE MorONs o_O "

PS, I've had induction since my first kitchen reno well over 10 years ago :)
It is as close to normal I am

    Latest update...

Tenants responded to the PM's reply to the breach notice. They acknowledge the offer of a cookware set (or a cash payment towards their own purchase) but say they did not ask for this offer and do not accept it (they still haven't said what they do expect me to do, despite asking them several times).

They also responded to say that their parents are visiting so it is a family of four that cannot cook their meals. They claim that they are ordering take away every day and are keeping the receipts to claim it as further compensation at the magistrate court. They also claim that because it states that the house has an induction cooktop on the PCR but not on the property listing, it was intentionally not disclosed to 'trick' prospective tenants.

    Fun days indeed.

    haha magistrates court,
I think you should recommend contacting the FBI, they may setup a wire tap on your PMs phone

    GET RID OF THE ASAP!

out of interest, what age group are they? kids? ethnicity? employment status?

You realise the person is in WA right? Magistrates court is what they have there instead of tribunal.

lol i wouldn't stress about it, keep fulfilling your duties as a landlord, and the rest will take care of itself. If they want to take it to court they can, but i see this as a risk-free case.

Maybe add it to the listing in future to prevent further issue but presumably there's not many more silly people in your suburb.

    @chooke

You've been more than accommodating, start playing hard ball. These kids will learn their lesson soon enough.

Should there be a judgment against @chooke in this matter, I'd happily make a donotion to help take this to appeal ;)
Spent so much time PMSL over this thread that I don't want it to end (without an outcome in @chooke favor anyway) :D

Thanks but there are no appeals from the small claims division of the magistrates court. It operates very similar to a tribunal, including parties not being able to bring legal representatives.

They are not kids, the couple seem to be in their early to mid 20s, Indian background and going by their writing, not very good English. Both are employed.

I consider early to mid 20's as kids. They're pretty much fresh out of home & need a lesson in life. Were probably told they were 'special' and parents indulged them with everything they want.
