New Lease..Tenants want to Vacate 3 weeks before Christmas

    Lease renewal scenario: Tenants want to vacate 3 weeks before Xmas..
    I can see vacancy 'til mid January because No One In Sydney wants to move just before Xmas..
    any thoughts?

    Obviously there is someone who wants to move pre-Xmas.

    Offer them 3 weeks less again ie mis-November so that showings can be from early November.

    We just had a situation where we were settling on a property around Christmas.....as part of the negotiations I moved the settlement until 1st week of feb.

    lucky....as PM was showing the property mid Jan but realistically not many people showed up until the weekend AFTER Australia day (though we did get 7 applications on that Saturday).

    When does the lease finish? Are they wanting to leave at the end of the lease? Break the lease? Are they month to month?

    Not much you can do if they are month to month except maybe offer a reduced rate to entice them over the holiday period. I always offer 13/14 month leases to get me into late January if the 12 month end falls in December. My last IP we got someone in on 17 December so some people are happy to get settled in just before Christmas.

    I don't like leases to end in December so will push them forward into January or even February these days as there is a glut in the market in early January because of this.

    But in saying that if you start advertising in November you may just have it rented before tenants vacate and have no vacancy over the Xmas break.

    When does their actual lease end?

    Your first post is unclear and several questions about whether or not you have a lease, when it finishes or are they month to month have yet to be answered.

    When does the lease finish? When the tenant wants to vacate doesn't enter into it if they are on a fixed lease that runs through Christmas. They might just have to continue to pay if they are breaking the lease.

    We aim for mid to late January for all leases, but I did once take a call on Christmas day, showed the property Boxing Day and they took it from then. I can happen, but is not ideal.

    The current lease expires 30 March 2017,
    the managing agency will likely be shut for X Mas.. last year they were closed 23 Dec till 9th Jan.
    For the new not yet signed lease Tenants want a discount in rent AND to leave beginning December.
    There are also other issues with this tenancy..
    I think it will be better for me if they vacate 30 March than just before Xmas
    ( you can be lucky if you self manage though)

    I'd let them leave. Unless you think the rent figure has dropped, I would not drop the rent for them. They won't want to move twice in a year, so you hold the upper hand.

    If they decide to stay at the same rent (assuming you agree to that), I would not be allowing the lease to finish three weeks before Christmas. But they are likely to just up and leave then anyway, so assuming you can get the same rent again, I'd send them packing at the end of this lease.

    Make sure you have enough time to give them this notice.

    And then find a better tenant.

    Bit rough on them I feel. They were honest with you when they told you their time line.

    I had tenants last December break lease due to a great opportunity and leave a place of mine. Had 7 party's through and two good applications. Didn't miss a days rent and got $50/week extra. Change over was the 10th

    I've signed leases on Christmas day.
    It slows down a little bit over that period but does not ever stop. There are leases signed 365 days of the year.

    The tenants said they wanted to stay on till November 2018, and a lot of other things, which I believed.
    Not sure if that is being honest.
    Sounds like you are local to your investment? Lucky!

    Just to let you know,
    they vacated 2 weeks ago, damaged the hot water service and took the dishwasher... among other things.
    I re-let it 3 days later .. with a lease til end Jan 2018 phew!

    yes, they took my dishwasher.......
    The agents haven't provided me with an outgoing inspection report, :mad:but the ingoing tenants no longer have a dishwasher.............., high end model
    it is a machine.........
    not a husband.......

    Have you got Landlord insurance?
